Divorce Filing
One party must reside within the
State of New York.
You must meet the qualifying guidelines to file for Divorce:
Both parties need to be in agreement over finances or related issues (i.e., child custody + support, healthcare, division of marital property or spousal support)
and must have a minimum of six (6) months separated.
For parties with only one party present, your spouse either agrees to the divorce, or fails to appear in the divorce action.

Only cases where your spouse either (1) consents to a divorce; or (2) where your spouse does not appear to oppose the divorce and parties do not share any assets or minor children, are suitable to be processed at Everything Aybar. You may sue for divorce thinking that the proceeding will be uncontested, but discover later that your spouse has decided to contest ("fight") the case.
